1. The "XWeighted.com" National Challenge Contest begins on January 11, 2010 at 12:00am (ET) and concludes on July 10, 2010 at 11:59pm ET the "Contest Period".  Entry in the contest ends on January 10 at 11:59pm ET. The contest is brought to you by XWeighted.com Productions Inc ("XWeighted.com") and CW Television Inc./Slice Network (“CW”) and any other prize or contest sponsor associated with this contest (collectively referred to as the "Contest Sponsors"). The contest will continue for a period of no less than 26 weeks and will consist of weekly prize draws the number of which will be at the discretion of the Contest Sponsors and three grand prize draws. 

2. The contest is open to all legal residents of Canada (other than residents of Quebec) who are eighteen (18) years of age or older as of the first day of the Contest Period. Contest is subject to all applicable federal and provincial laws and is void where prohibited by law.  No purchase is required to enter. For a chance to enter to win prizes you will need check “I agree” to the contest eligibility rules at the time that you register to become a Member of the website and participate in the XWeighted.com National Challenge (the “Challenge”).  If you check “I agree” to the weekly prize draws you will automatically be included in the weekly draws and to be eligible to win any of the weekly prizes you need to be registered as a participant in the Challenge and correctly answer a skill testing question if your name is drawn and sign the Contest Winner Release.  If you check “I agree” to the grand prize draws you will be included in the grand prize draws and also be required to meet the grand prize eligibility requirements.  To be eligible to win any of the grand prize draws, the contestant must have completed all 26 weeks of the Challenge and meet the eligibility requirements set out below.

To be eligible to receive any of the grand prize(s) you must:

(a) be outside of healthy BMI range as determined by the XWeighted.com system;

(b) accept the goal the XWeighted.com system determines for you;

(c) enter your weight each week for the 26 weeks of the Challenge.  You can not change your weight once entered, so please enter with care;

(d) complete the full 26 week Challenge;

(e) achieve or exceed the goal the XWeighted.com system determined for you in 26 weeks;

(f) provide us with a before and after photo;

(g) correctly answer a skill testing question; and

(h) sign the Contest Winner Release.

3.  Notwithstanding the above, the contest is not open to individuals associated with the contest, including the employees, agents or representatives (collectively, the Excluded Individuals") of the Contest Sponsors (including their respective divisions, subsidiaries, affiliates and advertising or promotional agencies) and suppliers providing prizes or other materials or services in connection with this contest. This contest is also not open to the immediate family members or legal spouses of the Excluded Individuals, and all other persons with whom the Excluded Individuals reside.

4. During the Contest Period entrants will be randomly selected from all eligible entries received during the Contest Period up to the date of the weekly draw.  At the end of the Contest Period, eligible entrants for the grand prize draws will be randomly selected from all eligible entries received during the Contest Period.  The winners will be posted on the Contest Sponsors’ websites, specifically the CW Television and/or Slice Network websites and the website located at www.xweighted.com and may be featured in the promotional spots related to the television program, X-Weighted on the CW Television networks, including without limitation Slice Network, during and following the Contest Period for a duration at the discretion of the Contest Sponsors.

5. All information submitted as part of the contest entries for any prizes become the sole property of, and are subject to verification by, XWeighted.com. Any entry that is incomplete, altered, or contains false information, is invalid. The use of any automated equipment to participate in this contest is prohibited.  Any attempt to tamper with the entry process, interfere with these contest rules, deliberately damage any website or undermine the administration, security or legitimate operation of the contest, is a violation of criminal and civil laws, and the Contest Sponsors reserve the right to seek damages and/or other relief from all persons responsible for such acts to the fullest extent permitted by law.

6. By entering the contest, each entrant agrees to abide by these contest rules, which are subject to change without notice to contest entrants individually, and each entrant releases the Contest Sponsors, their respective parents, affiliates, subsidiaries, directors, officers, employees, representatives, agents and advertising and promotional agencies, from any damage, loss or liability suffered as a result of or arising from the entrant's participation in contest or the use of any prize.

7. In order to be declared a winner by the contest judges, a potential winner must be in compliance with these contest rules and, in particular, the following:

(a) An XWeighted.com employee must be able to reach the potential winner by telephone or email within five (5) business days of the date on which the potential winner's entry was selected.

(b) The potential winner must correctly answer, within a set timeframe, a mathematical skill-testing question administered by an XWeighted.com employee by telephone.

(c) The potential winner must complete, sign and return a standard form Contest Winner Release within ten (10) business days from the date on which the form is sent to the potential winner. The winner must claim their prize as instructed by no later than 30 days after the date they were initially contacted.

8. If a potential or declared winner is not in compliance with the contest rules, the contest judges reserve the right to disqualify such entrant from the contest and randomly select further entrants from the remaining eligible entries until a winner is finally declared.  The prize shall be accepted as is and shall not be exchanged for an amount of money, is non-transferrable. No substitutions are allowed.

9.  By entering this contest all entrants consent to the collection, use and disclosure of their personal information (information that identifies them as an individual, for example, telephone number, age and address) by XWeighted.com for the purpose of administering this contest and awarding the prizes. This personal information shall not be used for any other purpose without the participant’s consent. By providing this information, participants consent to it being used for the stated purposes. XWeighted.com will store personal information for approximately 3 years. This information may be transmitted as required for the purpose of administering this contest and awarding the prizes.  

10.  XWeighted.com and the Contest Sponsors reserve the right, at their sole discretion and without prior notice, to amend, cancel, close, suspend or reinstate this contest at any time and for any reason whatsoever.  The contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations.  The contest and the contest rules shall be exclusively governed by and construed in accordance with the laws of the province of British Columbia. Any dispute shall be adjudicated in the courts sitting in Vancouver, British Columbia.
